The purpose of this Policy is to set out the data protection and data processing principles applied by UandB Kft., the operator of premiumpropertycare.hu (hereinafter: the Website), and the privacy and data processing policy of UandB Kft. (hereinafter: the Service Provider), which the Service Provider acknowledges as binding upon itself. The Service Provider’s objective is to ensure the protection of the personal data of users registered on the Website to the fullest possible extent.

By using the Website or any of its services or applications, the User consents to the processing of their personal data in accordance with the provisions of this Privacy Policy.

2. Definitions

The terms used in this Policy shall be interpreted in accordance with the definitions set out in Act CXII of 2011 on Informational Self-Determination and Freedom of Information (hereinafter: the Info Act), as follows.

Personal data: any data relating to the data subject, in particular the data subject’s name, identification number, and one or more pieces of information characteristic of the data subject’s physical, physiological, mental, economic, cultural or social identity, as well as any conclusion that can be drawn from the data concerning the data subject;

Data subject: any natural person identified or identifiable, directly or indirectly, on the basis of personal data; in the case of this Policy, the User;

Consent: the voluntary and explicit expression of the data subject’s wishes, based on adequate information, by which the data subject gives clear consent to the processing of personal data relating to them, either fully or in relation to specific operations;

Data processing: any operation or set of operations performed on data, regardless of the procedure applied, including in particular collection, recording, registration, organisation, storage, alteration, use, retrieval, transmission, disclosure, alignment or combination, blocking, erasure and destruction, as well as preventing the further use of data, taking photographs, sound or image recordings, and recording physical characteristics suitable for identifying a person, such as fingerprints, palm prints, DNA samples or iris images;

Data controller: the natural or legal person, or organisation without legal personality, who or which, alone or jointly with others, determines the purpose of data processing, makes and implements decisions concerning data processing, including the means used, or has such decisions implemented by a data processor engaged by them; in the case of this Policy, the Service Provider;

Data transmission: making data accessible to a specified third party;

Disclosure: making data accessible to anyone;

Data erasure: rendering data unrecognisable in such a way that restoration is no longer possible;

Data marking: marking data with an identifying mark for the purpose of distinguishing it;

Data blocking: marking data with an identifying mark for the purpose of restricting its further processing permanently or for a specified period;

Data processing activity: performing technical tasks related to data processing operations, regardless of the method and tools used to carry out the operations and regardless of the place of application, provided that the technical task is performed on the data;

Data processor: the natural or legal person, or organisation without legal personality, who or which processes data on the basis of a contract concluded with the data controller, including contracts concluded pursuant to legal provisions;

3. Principle of Data Processing

The Service Provider processes the recorded personal data in accordance with the data protection laws in force at any given time, in particular the Info Act, and in compliance with this Policy.

4. Purpose of Data Processing

The purpose of processing the User’s personal data is:

1. Sending newsletters and advertising messages, and fulfilling the Service Provider’s other legal obligations. The Service Provider does not disclose the User’s personal data to unauthorised third parties.

2. Contact: the Website provides the possibility to send a direct message to the Service Provider through the Website interface.

5. Scope of Processed Data

During and after the performance of the service provided by the Service Provider, the Service Provider processes the following personal data of the User on the basis of the User’s voluntary consent:

1. Newsletter and advertising: surname, first name, e-mail address

2. Contact: name, e-mail address, telephone number

The User is solely responsible for the authenticity and accuracy of the personal data provided.

6. Legal Basis for Data Processing

In connection with the operation and services of the Website, the collection and processing of personal data is based on the voluntary consent of the data subject.

1. Data processing for newsletter and advertising purposes: If the User requests this, the Service Provider is entitled to send advertisements and advertising-related electronic mail to the User. In this case, the User provides the Service Provider with the personal data specified in Section 5.1 required for sending newsletters. The legal basis for data processing is the User’s consent. The User acknowledges that, by providing their data, they simultaneously consent to the processing of such data for newsletter and advertising purposes.

Pursuant to Section 6(5) of Act XLVIII of 2008 on the Basic Requirements and Certain Restrictions of Commercial Advertising Activities (hereinafter: the Advertising Act), the Service Provider keeps a register of the personal data of users who subscribe to the newsletter. The data stored in the register is processed until consent is withdrawn, and is transferred to third parties only with the prior consent of the users.

2. Contact: the User’s voluntary consent.

The User grants consent by using the Website service, by registration, or by completing the contact form.

The Service Provider is not obliged to verify whether the data provided by the User during registration or otherwise when giving consent is true or accurate.

The User is entitled to withdraw their voluntary consent referred to in the previous section at any time. In this case, after the withdrawal, the Service Provider will no longer send newsletters or other advertising messages to the User and will delete the User’s data from the data of users subscribed to the newsletter.

Unless otherwise provided by law, the Service Provider may process the collected personal data without further separate consent, and even after the withdrawal of the User’s consent, for the purpose of fulfilling a legal obligation applicable to the Service Provider, in particular accounting obligations or contractual obligations concluded with the User, or for the purpose of enforcing the legitimate interests of the Service Provider or a third party, provided that the enforcement of such interest is proportionate to the restriction of the right to the protection of personal data.

7. Duration of Data Processing, Modification and Erasure of Data, Objection to Data Processing

The Service Provider processes the personal data handled in connection with the use of the services until the purpose of the data processing has been fulfilled.

The User may request the erasure of their personal data from the Service Provider by sending an electronic mail to [info@uandbcleaning.hu](mailto:info@uandbcleaning.hu). The Service Provider shall also erase the User’s personal data without the data subject’s request if the processing is unlawful, the purpose of processing has ceased, the statutory retention period has expired, erasure has been ordered by a court or by the Hungarian National Authority for Data Protection and Freedom of Information, or if the processing is incomplete or inaccurate and this condition cannot lawfully be remedied, provided that erasure is not excluded by law.

Instead of erasure, the Service Provider shall block the personal data if the User requests this, or if, based on the information available to the Service Provider, it can be assumed that erasure would harm the User’s legitimate interests. Personal data blocked in this way shall be processed by the Service Provider only for as long as the purpose of data processing that excludes the erasure of the personal data exists. After the withdrawal of the User’s consent, the Service Provider may continue to process personal data relating to the data subject in order to fulfil its statutory obligations, in particular accounting obligations.

The User may object to the processing of their personal data by sending an electronic mail to [info@uandbcleaning.hu](mailto:info@uandbcleaning.hu):

– if the processing or transmission of personal data is necessary exclusively for the fulfilment of a legal obligation applicable to the Service Provider, or for the enforcement of the legitimate interests of the data controller, data recipient or a third party, except in the case of mandatory data processing;

– if the personal data is used or transmitted for the purposes of direct marketing, public opinion polling or scientific research; and

– in any other case specified by law.

The data controller shall examine the objection within the shortest possible time from the submission of the request, but no later than within 15 days, shall make a decision on whether the objection is justified, and shall inform the applicant of its decision in writing.

If the data controller establishes that the objection of the data subject is justified, it shall terminate the data processing, including further data collection and data transmission, and shall block the data. It shall also notify all persons to whom the personal data affected by the objection was previously transmitted about the objection and the measures taken on the basis thereof, and such persons shall be obliged to take measures to enforce the right to object.

If the data subject does not agree with the decision made by the data controller, or if the data controller fails to comply with the 15-day deadline, the data subject may turn to court within 30 days from the communication of the decision or from the last day of the deadline. The court shall proceed without delay.

If the data recipient does not receive the data necessary to enforce their rights due to the data subject’s objection, the data recipient may, within 15 days from the communication of the notification, turn to court against the data controller in order to obtain access to the data. The data controller may also involve the data subject in the proceedings.

If the data controller fails to provide the notification, the data recipient may request information from the data controller regarding the circumstances of the failed data transfer. The data controller shall provide such information within 8 days from the delivery of the data recipient’s request. If information is requested, the data recipient may turn to court against the data controller within 15 days from the provision of the information, or at the latest from the expiry of the deadline for providing such information. The data controller may also involve the data subject in the proceedings.

The data controller may not erase the data of the data subject if the processing was ordered by law. However, the data may not be transferred to the data recipient if the data controller agreed with the objection or if the court established the legitimacy of the objection.

8. Requesting Information

The User is entitled at any time to request information about the personal data relating to them that is processed by the Service Provider in connection with the services of the Website, by contacting info@uandbcleaning.hu or by calling +36 30 407 7014. Upon the User’s request, the Service Provider shall provide information about the data relating to the User processed by the Service Provider in connection with the given service, the source of the data, the purpose, legal basis and duration of data processing, the name and address of the data processor, the legal basis and recipient of data transmission, and the Service Provider’s activities related to data processing. The Service Provider is obliged to provide the information in writing, in an intelligible form, within the shortest possible time from the submission of the request, but no later than within 30 days, upon the data subject’s request. The provision of information is free of charge. A request received from the e-mail address previously provided to the Service Provider shall be considered by the Service Provider as a request submitted by the User. In the case of requests submitted from any other e-mail address, or submitted in writing, the User may submit a request only if they have duly verified their user status.

9. Legal Remedies

10. Anonymised Data and Cookies

The premiumpropertycare.hu Website, e-mail messages and advertisements use so-called “cookies” and similar technologies, such as tracking codes, remarketing tags and pixels, which become active after the User’s consent.

These technologies help us better understand users’ behaviour and interests, thereby supporting a higher standard and more efficient operation.

13. Checking and Disabling Cookie Settings
